Terms of Service

Welcome to Tappraise, a service operated by Pixel Drift LLC ("Tappraise", "we", "us"). By creating an account or using the service, you agree to these Terms.

1. The service

Tappraise lets you photograph personal property, receive an AI-generated identification and estimated value, and optionally list items for sale on the Tappraise marketplace. You keep control of your listings and may edit or remove them at any time.

2. Appraisal estimates are not guarantees

All values, identifications, and comparable sales produced by our AI are automated estimates for informational purposes only. They are not a certified appraisal, an offer, or a guarantee of value, authenticity, or sale price. Do not rely on them for insurance, tax, legal, or financial decisions without independent professional verification.

3. Accounts

You are responsible for your account credentials and all activity under your account. Provide accurate information and keep it current. You must be at least 18 years old.

4. Listings and sales

You may only list items you own and have the legal right to sell. You are responsible for the accuracy of your listings, the condition and description of items, and compliance with all applicable laws. Prohibited items include (without limitation) illegal goods, counterfeits, stolen property, weapons where restricted, hazardous materials, and anything violating third-party rights. We may remove any listing at our discretion.

5. Fees, subscriptions, and payments

Paid plans, one-time packs, and marketplace commissions are described on our pricing page. Payments are processed by Stripe; by paying you also agree to Stripe's terms. Subscriptions renew automatically until canceled; you can cancel anytime and retain access through the current period. Marketplace sales are subject to a commission that is disclosed before you list, deducted from your payout, in addition to payment-processing fees.

6. Seller payouts

Payouts to sellers are handled through Stripe. You may be required to complete identity verification (KYC) with Stripe before receiving funds. Payout timing and any holds are subject to Stripe's processes and applicable law.

7. Refunds and disputes

Sale disputes between buyers and sellers should first be resolved between the parties. We may, but are not obligated to, mediate. Chargebacks and refunds are subject to Stripe's rules.

8. Intellectual property

You retain ownership of the photos and content you upload and grant us a license to host, display, and use them to operate and promote the service (including on the public marketplace). The Tappraise name, software, and design are ours.

9. Disclaimers and limitation of liability

The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Pixel Drift LLC is not liable for any indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the twelve months before the claim.

10. Termination

You may stop using the service at any time. We may suspend or terminate accounts that violate these Terms or the law.

11. Governing law

These Terms are governed by the laws of the State of California. Disputes will be resolved in the courts located in Santa Barbara County, California.

12. Changes

We may update these Terms. Continued use after changes means you accept them.
